Agreement to Terms

By accessing and using the services of UpFront Encinitas Fencing, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our services. We reserve the right to modify these terms at any time, and your continued use of our services constitutes acceptance of any changes.

Services Provided

UpFront Encinitas Fencing provides professional fence installation, repair, and replacement services in Encinitas, CA and surrounding areas. Our services include:

• Material selection guidance
• Project planning and estimates

Quotes and Estimates

All quotes and estimates provided by UpFront Encinitas Fencing are valid for 30 days from the date of issue unless otherwise specified. Quotes are based on the information provided at the time of assessment. If site conditions differ from what was initially assessed, or if you request changes to the scope of work, the final price may be adjusted accordingly. We will always communicate any necessary changes before proceeding with the work.

Payment Terms

Payment terms will be clearly outlined in your service agreement. Generally, we require:

• A deposit to secure your project start date
• Progress payments for larger projects as outlined in your agreement
• Final payment upon completion and your satisfaction with the work
• Payment can be made via check, cash, or credit card

Project Scheduling and Delays

We make every effort to complete your project on schedule. However, delays may occur due to weather conditions, material availability, permit processing, or unforeseen site conditions. We will communicate any delays promptly and work with you to minimize inconvenience. UpFront Encinitas Fencing is not liable for delays caused by circumstances beyond our reasonable control.

Property Access and Site Preparation

You agree to provide clear access to the work area and to remove any obstacles that may interfere with the installation. This includes moving outdoor furniture, decorations, and ensuring pets are secured. If we encounter unexpected underground utilities, rocks, or other obstructions, additional charges may apply. We recommend calling 811 before your project begins to mark underground utilities.

Warranties and Guarantees

We stand behind the quality of our workmanship and offer warranties on our installation services. Manufacturer warranties apply to materials used. Specific warranty terms will be provided in your service agreement. To maintain your warranty, you must follow recommended maintenance procedures and notify us promptly of any issues.

Limitation of Liability

UpFront Encinitas Fencing will perform all work with reasonable care and skill. Our liability is limited to the cost of the services provided. We are not liable for indirect, consequential, or incidental damages. We carry appropriate insurance coverage for our operations, and details are available upon request.

Permits and Regulations

While we can assist with permit applications, you are ultimately responsible for ensuring that your fence project complies with local zoning laws, HOA regulations, and building codes. We recommend checking with your local planning department and HOA before starting your project. Additional fees may apply for permit acquisition services.

Cancellation Policy

If you need to cancel your project, please notify us as soon as possible. Cancellation fees may apply if materials have been ordered or work has begun. Any deposits paid are non-refundable if materials have been specially ordered for your project.
